Privacy policy

It is normal for you to be concerned about how your data is obtained, used and shared.


Accordingly, this privacy policy (hereinafter the "Policy") has been drafted to inform you of the practices and conditions under which Semarchy S.A. - Société Anonyme registered in the Lyon Trade and Companies Register under number 528 608 003 and whose offices are located at 55 ter Avenue René Cassin 69009 Lyon (hereinafter "Semarchy" or the "Company") collects, uses and retains your personal data (hereinafter the "Data").


Here you will find the various Data that we may collect and process or that you may transmit to us in the course of using the Semarchy Academy platform (hereinafter the "Platform").


The Platform offers two types of distance learning courses:

• e-learning courses online educational content (hereinafter referred to as "E-learning courses"),

• remote training provided by a trainer (hereinafter "Hybrid-Learning Training").

All of the above mentioned trainings will be referred to as "Trainings".

Any subscription to Training will be subject to this Policy.



Article 1 - Data controller

Semarchy, acting as a data controller, within the meaning of the General Data Protection Regulation 2016/679 dated 27 April 2016 and the amended "Informatique et Libertés" law of 6 January 1978 attaches great importance to the principle of personal data protection.



Article 2 - Collected data

2.1. Personal data

• Semarchy is likely to collect the following Data:

• Data relating to your identity such as your name, first name, e-mail address, telephone number;

• Browsing data: IP address, browser used, browsing time, search history, operating system used, language and pages viewed;

• Transaction Data such as your shopping cart, transaction amount and date, etc. ;

• Data related to your professional life;

• Telephone conversation data.



2.2. Non-personal data

You acknowledge that the following items are not personal data, and may not be subject to modification or deletion:

All data related to a company, including but not limited to: a company name, a company phone number, a company email address, a trademark, a company name, a link to a company web page or a company social network profile;

Any technical or computer data, including but not limited to: the code and components of a module distributed under an open source license, computer formulas.



Article 3 - Collection

Data can be collected directly when you communicate with us through the user account creation form or contact form and/or when you communicate with Semarchy by phone or email. When you contact us through these different means, a copy of your exchanges with Semarchy, including email addresses, is made and archived.

Semarchy also indirectly collects your Data through cookies/trackers. Please review our Cookie Policy below, which is designed to help you better understand these technologies and how we use them on our Platform and in connection with our services, applications and tools.



Article 4 - Purposes and legal bases

Semarchy may collect your Data for the following purposes:

Provide our Services in accordance with our contractual commitments (Platform Terms and Conditions).

-> account creation necessary for access to the Trainings, subscription management, management of participation in our Trainings, invoice management, litigation management, assistance, etc.

To provide and improve our services in accordance with our legitimate interest (analysis and improvement of services).

-> ensure the proper functioning of our Services, test additional features or services

To evaluate and analyze performance in accordance with our legitimate interest (analysis and improvement of services).

To communicate with you in accordance with our legitimate interest. We consider that we have a legitimate interest in responding to the questions or consultations you have raised through the various existing contact channels.

-> management of information requests and comments, respond to your contact requests, advise you, communicate changes and updates, alert you to security incidents, etc.

To carry out marketing actions in accordance with our legitimate interest. According to the recommendations of the CNIL in terms of B2B commercial prospecting, you are likely to receive commercial communications for similar products or services. You may object to this processing at any time, from the collection form or directly in the e-mails received.

Article 5 - Recipients

5.1. Processing of your Personal Data by Semarchy employees

Semarchy employees may process your Personal Information.


5.2. Processing of your Personal Information by our third party trainers

In the context of Training provided by a third party trainer, your Data may be transferred to them in order to allow you to participate in the subscribed Training.

This third party trainer is a separate data controller from Semarchy.


5.3. Processing of your Personal Data by our Subcontractors

In the course of our business, and for external processing purposes, your Data may be communicated to subcontractors, service providers or other third parties.

The latter are bound by a Data Outsourcing Agreement to respect the confidentiality of the Data and to use it only for the purposes for which we transfer it to them. In addition, transfers of Personal Data outside of the European Union are subject to the signing of Standard Contractual Clauses with the latter.

For the management of our Trainings, your Data may be processed by :

- Yunoo Ltd (London),

- 360 Learning (France),

- Semarchy’s B&C, SAS (France),

The latter are bound by contractual obligations to respect the confidentiality of the Data and to use it only for the purposes for which we provide it.


5.4. Processing of your Data for legal purposes

We may also disclose your Data:

• to comply with any legal mandate, statute or process, including government and regulatory requests;

• if we believe that disclosure is necessary or appropriate to protect the rights, property or safety of Semarchy, its customers or other stakeholders. Such disclosure includes exchanging information with other companies and organizations for the purpose of protecting against fraud and forgery.

Your Data may be transferred to any purchaser or other successor in the event of a merger, divestiture, reorganization, dissolution or other sale or transfer of some or all of Semarchy's assets due to uncertainties or bankruptcy, liquidation or other processes in which User Data from the various Semarchy sites is one of the assets transferred.



Article 6 - Data Transfers

In accordance with Article 5 above, Data may be transmitted to our Partners and/or Subcontractors located outside the European Union. In this case, Semarchy makes every effort to ensure the security of the Data transmitted outside the European Union, in particular by signing the European Commission's Standard Contractual Clauses and by implementing additional guarantees.

By using the Platform or by subscribing to a Training, you agree that your Data will be transferred to these servers.



Article 7 - Retention Period

Semarchy only keeps your Data for the time necessary to fulfill the purposes set forth in Article 4.

This retention period is not the same depending on the Data in question, the nature and the purpose of this collection. Similarly, certain legal obligations impose a specific retention period.

The Data collected for the creation of your account is kept until the user deletes the account.

When you participate in one of our trainings, all Data related to your participation in these trainings will be kept for ten (10) years from their completion.

When you contact Semarchy via the contact form available on the Site, your Data will be kept for three (3) years from the last exchange and then deleted.

Finally, with respect to Data collected by means of cookies or tracers, they will be kept for the period indicated in the Cookie Policy below.



Article 8 - Rights

8.1. Rights to your Data

In accordance with the provisions of the applicable regulations on the protection of personal data, in particular the European Regulation 2016/679 on Data Protection (hereinafter the "RGPD") as well as the "Informatique et Libertés" law of January 6, 1978 as amended, we undertake to guarantee the exercise of your rights.

Regardless of the purpose or legal basis of the processing, you have:

• A right of access to the Data we have on you,

• A right to rectify your Data that we already have,

• A right to delete your Data,

• A right to limit the processing of your Data,

• A right to define directives concerning the fate of your Data in case of death.

If you have given us your consent to process your Data, you also have the right to withdraw this consent at any time. However, the withdrawal of consent does not in any way render unlawful the processing already carried out on this legal basis.

If you have given us your consent to process your Data or the processing is based on contractual performance, you have a right to the portability of your provided Data.

Finally, if the processing is based on the legitimate interest of Semarchy, you have a right to object on legitimate grounds in accordance with Article 21 of the GDPR; when data is processed for canvassing purposes, you will not be required to provide grounds.


8.2. Exercise of these rights

We have a period of one month to respond to any request for the exercise of your rights from the time we receive the request. This period may be extended by two months, due to the complexity or excessive number of requests.

In accordance with Article 12.6 of the GDPR, in order to exercise these rights, Semarchy, as data controller, reserves the right to ask you to prove your identity. We inform you that the data allowing to justify your identity will be deleted once we have answered your request.

Finally, you have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL), notably on its website www.cnil.fr.



Article 9 - Data Security

Your Data is stored on secure servers protected by firewalls and antivirus software.

We have implemented technical and organizational measures to ensure the security and confidentiality of your Data against accidental loss and against unauthorized access, use, modification and disclosure.

However, due to the inherent characteristics of the Internet, we cannot guarantee the optimal security of information exchanges on this network.

We cannot be held responsible for any breach of the privacy settings or security measures in place on our Platform.

As such, you agree that the security of your information is also your responsibility.

In particular, we advise you to keep the password that allows you to access your user account secret and to avoid any disclosure to third parties.

We also advise you to be particularly careful when disclosing information in the public areas of the Platform, as these areas can be viewed by any user of the Platform.

The Platform may contain links to various social networking platforms run on third party servers, by persons or organizations over which Semarchy has no control.

As a result, we cannot be held responsible for how your Data is stored or used on the servers of these third parties.

Section 10 - Policy Review

As laws and regulations regarding technology and privacy continue to evolve, this Policy is likely to be updated.

If you are a user of the Platform, you will be informed of any major changes by email.

If any provision of this Policy is found to be invalid or unlawful, it shall be deemed unwritten but shall not invalidate the remaining provisions of the Policy.
